With the Supreme Court of Pakistan facing a significant backlog of cases, Chief Justice of Pakistan (CJP) Justice Qazi Faez Isa remarked on Monday that the trend of seeking another date for hearing will no longer be entertained by the Supreme Court. Chief justice remarked that adjourned will not be given in Supreme Court, this message should reach all.

CJP Qazi Faez Isa made the remarks as a three-member SC bench headed by him and comprising Justice Aminuddin Khan and Athar Minallah heard a case related to a land dispute of Quetta, during which the lawyer Qazi Ghulam Dastagir sought to adjourn the hearing for a later date. The petition was filed by Abdul Abbas against Director General, Quetta Development Authority, Quetta and others.

In response to the lawyer’s request to award more time for preparation of the arguments, CJP Qazi Faez Isa reprimanded the lawyer and told him to forget the idea of seeking a later date.

“Through you, this is also a message for everyone that the trend of seeking adjournments will no longer fly. The number of cases pending before the apex court is quite high,” he said.

He further said that “notice should be issued during first hearing while arguments should be heard at the next date and case should be decided”.

He said that in other courts, another date was given for the hearing in order to furnish more documents. “If a case comes to the SC, all the record of the case is present,” he said, as the court rejected the lawyer’s plea.

Chief justice while addressing the lawyer said that if the lawyer has no voice then he should quit the practice. Chief justice while addressing the lawyer said that sometimes the lawyer is speaking in English and sometimes in Urdu. Chief justice directed the lawyer to argue in one language and should improve his English and Urdu language. Chief justice asked the lawyer to show the court where they have not taken money of the property. Chief justice also questioned where are the other legal heirs of the property? Chief justice said that one man has come to end the award after 35 years later. Chief justice said that those against in favor the award was they not made the party in the case. Chief justice addressing the counsel said that he should move forward according to law.

The court rejected the lawyer’s plea for granting more time for preparation of the arguments. The court declined the leave and dismissed the petition.
