Petition filed in IHC to declare illegal, unlawful, mischievous, malicious & criminal tweets posted from the official account of Imran Khan

Petition has been filed in Islamabad High Court (IHC) to declare the illegal, unlawful, mischievous, malicious and criminal impugned tweets posted from the official account of  Pakistan Tehreek-e-Insaf’s (PTI) former chairman and former prime minister Imran Khan.

The petition has been by Ghulam Murtaza Khan Advocate through his lawyers Advocate Supreme Court of Pakistan Barrister Zafarullah Khan, Advocate High Court Barrister Qassim Dugal and Advocate High Court Swim Raja. National Cyber Crime Investigation Agency, 2nd Floor, National Police Foundation Building, Mauve Area, Sector G-10/4, Islamabad- through its director general, Pakistan Telecommunication Authority, PTA Headquarters, sector, F-5/1, Islamabad-through its chairman, Jail Superintendent, Central Jail, Adiala, Rawalpindi, Imran Ahmed Khan Niazi, convict, detained in the central jail, Adiala, Rawalpindi and Pakistan Tehreek-e-Insaf, Central Secretariat, plot No-1-A, street No-32, Sector G-8/4, Islamabad-through its Chairman.

The petition filed under Article 199 of the Constitution of the Islamic Republic of Pakistan 1973 is consisting of 76 pages.

It is said in the petition that PTI though its organizational structure, office-bearers, media teams and digital wings, is actively aiding, abetting, and facilitating the illegal, unlawful, mischievous, malicious, and criminal impugned tweets, emanating from the official twitter (X) handle @ImranKhanPTI in the name of respondent No-4. By permitting and endorsing the continued publication of such illegal, unlawful, mischievous, malicious and criminal impugned, tweets, the respondent No-5 is complicit in the violation of the constitution, statutory laws, and the dignity of Pakistan’s constitutional institutions, thereby rendering itself a necessary and proper party to these proceedings.

It has been prayed in the petition that the court may declare the illegal, unlawful, mischievous, malicious and criminal impugned tweets posted from the official account of the Respondent No.4 while in judicial custody are illegal, unlawful and unconstitutional and against various laws of Pakistan.

The court may also direct that the Respondent No-1 and 2 to immediately investigate, identify, and restrain the individuals/teams operating the illegal, unlawful, mischievous, malicious and criminal impugned tweets on behalf of a convict/prisoner, and take action in accordance with the law.

It has also been prayed that the court may direct the respondent No-2 to block/remove the illegal, unlawful, mischievous, malicious and criminal impugned tweets, uploaded from the said account.

It has also been requested that the court may direct the respondent No-3 to ensure strict compliance with prison rules, ensuring no convict/prisoner is permitted to unlawfully operate social media account.

It is also prayed that the court may direct the respondent No-04 to immediately stop engaging in this illegal and unconstitutional activities.

It has also been prayed that the court may direct respondent No-5 not to re-circulate/spread the illegal, unlawful, mischievous, malicious and criminal impugned tweets of the respondent No-04. It is also prayed that the court may also grant any other relief deemed just and proper in the facts and circumstances of the case. The petitioner has also attached the tweets of Imran Khan with the petition.
